Buy American Act

The USMCA replaced NAFTA in 2020 and allows Beta-Calco luminaires to meet the requirements of the Buy American Act under the Federal Acquisition Regulation (FAR) agreement.

The FAR defines a "Free Trade Agreement country end product" as an article that is wholly produced or manufactured in a Free Trade Agreement (FTA) country or, in the case of an article made with materials from another country, has been substantially transformed in an FTA country into a new and distinct article. Beta-Calco's luminaires qualify under option 2 of the FAR due to the USMCA exemption.

Additionally, Beta-Calco's luminaires are considered commercially available off-the-shelf (COTS) items and are widely sold in the commercial lighting industry. They meet the same specifications required for construction projects and are readily available to all commercial contractors.

The Buy American requirement may not apply if the materials used in a project are from countries with relevant international agreements, such as signatories to the World Trade Organization Government Procurement Agreement or countries with Free Trade Agreements with relevant procurement provisions. In this case, the USMCA exemption would supersede the requirements of the America Recovery and Reinvestment Act (ARRA).
